Subscription Terms

Effective as of December 1, 2025

By purchasing a Subscription you agree to the following terms and conditions (the “Subscription Terms”), which supplement and form a part of the FITURE’s Terms of Service(the “Terms of Service”). These Subscription Terms are subject to the Terms of Service and in the event of any conflict between them, the Terms of Service shall control and take precedence. Capitalized terms used but not defined here have the meanings given to them in the Terms of Service.

 

1.       Member. A “Member” is any individual who has the FITURE account for personal, non-commercial use.

2.       Subscription. By purchasing a Subscription you will have access to FITURE’s certain premium features and benefits via the Product and the mobile Application, as applicable, to which your Subscription is entitled for as long as the Subscription remains active. You agree to pay the Subscription fee (plus any applicable taxes and other charges) for a lifetime or on a monthly or annual basis, in advance, for your Subscription.

3.       Price Changes. FITURE, at our sole discretion and at any time, may modify the Subscription price. Any Subscription price change will become effective at the expiration of your then-current Commitment Period. FITURE will provide you with a reasonable prior notice of any change in Subscription price to give you an opportunity to cancel your Subscription before such change becomes effective. Your continued use of the Services after the Subscription price change comes into effect constitutes your agreement to pay the modified Subscription price.

4.       Billing Authorization. You agree to pay us, through the third party provider for payment services (as Stripe, Inc. and its affiliates, Google Pay, App Store), all charges at the prices then in effect for any purchase in accordance with the applicable payment terms presented to you at the time of purchase. You agree to make payment using the payment method you choose when you pay for your Subscription. You hereby authorize us to charge your specified payment method on a monthly or annual basis in line with your Commitment Period, in advance, for your Subscription and/or to place a hold on your payment method with respect to any unpaid charges for your Subscription. You authorize us to continue to attempt to charge and/or place holds with respect to all sums described herein, or any portion thereof, to your payment method until such amounts are paid in full. You acknowledge and agree that FITURE will not have any liability whatsoever for any insufficient funds or other charges incurred by you as a result of attempts to charge, and/or place holds on, your specified payment method as contemplated by these Subscription Terms.

5.       Other offers. FITURE may offer additional promotions or discounts related to Subscriptions from time to time at our sole discretion. Please read the details of those offers carefully before purchasing, as any additional terms presented to you during the sign up process will form part of these Subscription Terms. Unless specified in writing, all discount offers that require a payment are non-refundable. Any promotion must be used within the specified time frame of the promotion.

6.       Bill Inquires and Refund. If you believe you have been billed in error for a Subscription, please notify us within 30 days of the billing date by emailing cs@fiture.com. Certain refund requests for Subscriptions may be considered by FITURE on a case-by-case basis and granted in sole direction of FITURE. FITURE will not issue refund after the expiration of this 30-day period, except where required by applicable law.

To avoid any ambiguity, if you provide App Store or Google Pay as your payment method, in the event you may want a refund, please contact Apple or Google directly. Apple and Google will determine your eligibility for a refund according to their policies and applicable procedures. If a refund is approved, it will be issued by Apple and Google, we don’t have the authority to grant refunds and do not process them directly, as all payment-related matters are managed by Apple and Google.

7.       Commitment Period. When you first sign up for a Subscription you must agree to a specific price and plan, which may include a commitment period term of at least one month (“Commitment Period”). The Commitment Period commences on the day that you activate your Subscription on the mobile Application. You agree to maintain your Subscription for the applicable Commitment Period. The price available with your plan is valid until the Commitment Period expires, at which time your Subscription will automatically continue at the then-current non-promotional price for your Subscription level.

8.       Auto-Renewal. YOU AGREE THAT, UNLESS YOU OPT OUT OF AUTO-RENEWAL AT LEAST 24 HOURS BEFORE THE EXPIRATION OF YOUR THEN-CURRENT COMMITMENT PERIOD, YOUR SELECTED SUBSCRIPTION PLAN WILL BE AUTOMATICALLY RENEWED AT THE EXPIRATION OF THE COMMITMENT PERIOD AT THE THEN-CURRENT NON-PROMOTIONAL PRICE FOR YOUR SUBSCRIPTION.

Upon renewal of your Subscription, if we do not receive payment from your payment provider, we may terminate your Subscription. You will lose access to all the premium features and benefits of BodyPark ATOM that require a Subscription. You will not receive any refund or credit for any unused portion of your Subscription.

9.       Cancellation by User. Cancellation of a Subscription may be done at any time through your payment provider’s related page (such as Apple ID account settings). Cancellation will be effective at the end of the current Commitment Period, and you will retain access to the premium features until the conclusion of that period. After that, you will lose access to all the premium features and benefits of BodyPark ATOM that require a Subscription. You will not receive any refund or credit for any unused portion of your Subscription.

10.    Suspension/Termination by FITURE. FITURE may immediately suspend or terminate your account, and all or portion of your Subscription, without notice if:

  1. your payment is overdue;
  2. you provide false or inaccurate information;
  3. you engage in conduct that is a violation of any applicable law or tariff (including, without limitation, copyright and intellectual property laws); or
  4. if you engage in conduct that is threatening, abusive or harassing to FITURE employees, agents, or other FITURE users, including, for example, making threats to physically harm or damage property;
  5. you violate these Subscription Terms, the Terms of Service or any other FITURE rules or agreements then in effect.

After FITURE terminates your account and your Subscription, you will lose access to all the premium features and benefits of BodyPark ATOM that require a Subscription. You will not receive any refund or credit for any unused portion of your Subscription. Furthermore, FITURE reserves the right to delete all data, files, and other information stored in or for your account without further notice, in according with the Terms of Service.
